These Terms of Service ("Terms") constitute a legally binding agreement between you and MEDINA FOOD GROUP LIMITED ("Medina"). By accessing our website, using our mobile application, or engaging our logistics services, you agree to be bound by these Terms in their entirety. If you do not agree to these terms, you must immediately cease use of our services.
1. SERVICE PROVISION AND ELIGIBILITY
Medina provides a technology-enabled food production and delivery platform. Our services are available only to individuals who are at least 18 years of age and possess the legal capacity to enter into binding contracts. We reserve the right to refuse service to any entity or individual at our sole discretion, particularly in cases where safety or regulatory compliance is at risk.
2. INTELLECTUAL PROPERTY AND LICENSING
The 'MedinaCore' software, our proprietary routing algorithms, branding, visual designs, and the specific '83 Park Road' culinary formulations are the exclusive intellectual property of MEDINA FOOD GROUP LIMITED. We grant you a limited, non-exclusive, non-transferable license to access our platform for personal or authorized business use only. Any attempt to reverse-engineer, scrape, or unauthorizedly access our API endpoints is a direct violation of this agreement and the Computer Misuse Act 1990.
3. PRICING, PAYMENTS, AND TAXATION
All prices displayed on our platform are inclusive of VAT at the prevailing UK rate, unless otherwise stated for B2B corporate contracts. Our base pricing for premium logistics packages starts at £300, subject to specific volume adjustments. Payments are due at the point of order through our authorized payment gateways. We do not store full credit card details on our local servers.
4. DELIVERY PROTOCOLS AND LIABILITY
Medina utilizes AI-driven predictive modeling to provide delivery windows. While we maintain a 92% accuracy rate, these windows are estimates. Medina is not liable for delays caused by force majeure events, including extreme Yorkshire weather, civil unrest, or infrastructure failure. Our liability for any order is strictly limited to the total monetary value of that specific order. We are not liable for indirect or consequential losses resulting from a delayed or cancelled delivery.
5. FOOD SAFETY AND ALLERGENS
We adhere to the highest UK Food Standard Agency (FSA) ratings. However, users are responsible for communicating all life-threatening allergies through our platform's designated interface. While we maintain strict cross-contamination protocols, our kitchens handle a variety of ingredients. By ordering, you acknowledge this inherent risk in a multi-use culinary environment.
6. GOVERNING LAW AND DISPUTE RESOLUTION
This agreement is governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Leeds or London. We encourage an initial period of 30 days for informal mediation prior to any legal proceedings.
